    The legal obligation of every employee is to perform voluntary work under the employer's supervision. The situation is no different in the case of work classified as particularly dangerous. The exception to the rule is when you refrain from working - for safety reasons. The possibility of refraining from work will also apply to particularly dangerous work - regardless of the fact that above-average technical and organizational measures are used to ensure safety - including ongoing supervision of the work.
  • Work prohibited for minors after September 30, 2023.
    On September 30, 2023, the regulations regarding work prohibited for minors changed. The issues of the possibility of employing minors are regulated by the new regulation of the Council of Ministers of June 19, 2023 on the list of works prohibited for minors and the conditions of their employment in some of these works (Journal of Laws of 2023, item 1240), which replaced the previously applicable regulation of August 24, 2004 with the same name. Make sure you know the new obligations for employers and check which issues remain unchanged.

Since the employer wants the employee to return to work as soon as possible, it would be in his interest for the employee to undergo a medical check-up while still on sick leave (for example, on the last day) and to appear on the first working day after the period of sick leave with a decision confirming that there are no contraindications to work. Is this solution acceptable? Can check-ups be carried out during sick leave?

    Machines are essential equipment used in every industrial workplace. Thanks to modern machine capabilities, plants increase their production and product quality. Production lines are becoming more automated. Machines have many advantages, this cannot be denied. However, please remember that they usually require an employee to use them. The operator, among other things, is obliged to start the machine, equip it with raw material, supervise the operation of the machine and collect or redirect the final product. Accidents may occur during these activities. The second group of employees exposed to machine-related accidents is the maintenance crew. Their task is to keep the machine in good technical condition.

    Does the list of work prohibited for minors in a given workplace have to be approved by the competent Inspector of the National Labor Inspectorate? If so, how should it be approved?

I practice the date of the injured party's written notification of the reported accident, in which the injured party personally completes the report and informs about the incident and the consequences of the accident, as well as about the accident witnesses and medical records.
