  • Participation of employees in a health program or a preventive health program as part of occupational medicine research
    The fundamental duty of every employer is to protect the health of employees, including providing them with safe working conditions. The basic legal instruments in the field of health protection of employees in Poland include preventive examinations of employees. The issue of preventive medical examinations of employees is primarily regulated by the Labor Code. According to it, the employer is obliged to organize and provide preventive health care for employees. The provisions of the Labor Code regarding employee examinations were recently amended by the Act of December 1, 2022 (Journal of Laws of 2023, item 240). The amendment to the regulations concerns the possibility of directing employees during preventive examinations carried out in an occupational medicine unit to participate in a health program or a health policy programme. The above amendment to the Labor Code has been in force since February 21, 2023. Legal basis and types of preventive examinations of employees The basic source of law in the field of occupational health protection is the Act of June 26, 1974 - Labor Code (LC), which regulates the rights and obligations of the parties to the employment relationship. Article 229 of the Labor Code is the basic, general regulation of Polish law in the field of preventive examinations of employees. It specifies the types of preventive examinations to which the employee is subject, as well as the general rules for their provision. Article 229 § 8 of the Labor Code contains an authorization for the legislator to issue executive regulations regarding preventive health check-ups of employees. On the basis of the above statutory delegation, the Minister of Health issued the regulation of 30 May 1996 on the conduct of medical examinations of employees, the scope of preventive health care for employees and medical certificates issued for the purposes provided for in the Labor Code, hereinafter referred to as the regulation of 1996.

  • On the organization, conditions and safety in the working environment of farmers from the mid-19th century 19th to mid 19th century 20th century (part 2)
    The working conditions of peasants in the Polish territories under partition are not the dominant trend in historical research. This is not changed even by the fashion for publications in the field of so-called folk history of Poland. In this "people's turn" of the current Polish historiography, there is no trace of searching how the working conditions of peasants, almost 90 percent of the then population of the Polish lands in the 19th and early 20th centuries, influenced their national or social consciousness. We continue our reflections on the working environment of farmers from issue 6/2023.
  • Polish versions of standards for protective clothing harmonized with Regulation 2016/425/EU
    Last and this year, the Polish Committee for Standardization published a number of standards specifying the requirements for protective clothing harmonized with Regulation (EU) 2016/425 of the European Parliament and of the Council of 9 March 2016 on personal protective equipment and repealing Council Directive 89/686/EEC. PN-EN ISO 13688:2013-12/A1:2022-02 standard Protective clothing. General requirements was published on April 17, 2023, consists of 16 pages and introduces EN ISO 13688:2013/A1:2021. The document specifies general performance requirements in the field of ergonomics, harmlessness, size marking, aging process, compatibility and marking of protective clothing and information that should be provided by the manufacturer with the product. This standard is intended to be used only in conjunction with other performance-specific standards and cannot be used as a stand-alone reference document.     In the ATEST 5/2022 magazine, we published an article by B. Ziędalski "I like health and safety instructions" on the general principles of creating health and safety instructions. Regulation of the Minister of National Defense of 15 May 2023 on the fund for discretionary awards and allowances for professional soldiers (Journal of Laws, item 1034). Date of entry into force: July 1, 2023. 64. Ordinance of the Minister of Health of May 25, 2023 amending the ordinance on the list of alarm factors, registers of nosocomial infections and alarm factors, and reports on the current epidemiological situation of a hospital (Journal of Laws, item 1041) . Date of entry into force: June 1, 2023. 65. Ordinance of the Minister of Development and Technology of May 9, 2023 amending the ordinance on institutions authorized to issue opinions on the fulfillment of technical and organizational conditions for the manufacture and trade in explosives, weapons, ammunition and articles and technology for military or police purposes (Journal of Laws, item 1042).
  • The deadline for submitting a notice of dismissal without notice to the employee
    Commencement of the time limit under Art. 52 § 2 k.p. is dictated by the relationship between the scope of the employer's knowledge and the premises justifying termination of employment. This means that the time limit will start to run from the moment when - objectively measured - the employer's knowledge of the employer allows him to assess whether the conditions contained in the phrase "serious breach of basic employee duties" have been met. Therefore, the employer should be aware of the unlawfulness of the employee's behavior (breach of basic duty), violation or (serious) threat to the interests of the employer, as well as fault. The period in question begins only from the end of the promptly and efficiently conducted internal verification procedure, especially when information about the employee's reprehensible behavior comes from the outside.
