    Under heading 3 point 1 of the list of occupational diseases there is a professional disease of silicosis. What should be considered when recognizing pneumoconiosis as a occupational disease? Can a negative decision in this respect be an obstacle to initiating another case in the future regarding the diagnosis of occupational disease of silicosis of the lungs?

    Under heading 6 of the list of occupational diseases, there is bronchial asthma. In the case of an employee employed in an agricultural holding while conducting animal husbandry, should also the exposure to factors occurring in an agricultural holding, but in the cultivation of plants, be examined? Can in some circumstances a pathogenic biological agent cause disease even in subliminal concentrations?
  • The possibility of finding a professional disease despite the resolution of its symptoms (7)
    Is it possible to derive from the definition of occupational disease that at the time of issuing the decision on the diagnosis of occupational disease and the decision stating this disease, an employee or former employee must suffer from the disease? Do the regulations allow the possibility of diagnosis of occupational disease in cases where, apart from the finding that the disease may have been caused by factors harmful to health in the work environment or in connection with the way the work was done, other disfunctions of the subject's organism were also revealed, predisposing to the condition mentioned in list of occupational diseases?
  • Physician's responsibility for prevention for the content of decisions on contraindications or lack of contraindications to employees' work (10)
    One of the employer's obligations resulting from the provisions of the Labor Code is the admission of employees with current medical certificates stating that there are no contraindications to work in a given position. According to the provision of art. 229 § 4 Labor Code the employer can not allow the employee to work without a current medical certificate stating that there are no contraindications to work at a particular position in the working conditions described in the referral for medical examinations. However, this means not only an obligation on the part of the employer, but also the employee's obligation to undergo the tests.
