    Pursuant to the regulation in force, employing juveniles in conditions of exposure to technological processes in which chemical substances, their mixtures or carcinogenic or mutagenic substances are released is not allowed. In the case of a carpenter, it will be wood dust, while a mechanic may be exposed to exhaust fumes from diesel engines.

    List of carcinogenic or mutagenic agents and technological processes, included in Annex 1 to the Regulation of the Minister of Health of 24 July 2012 on chemical substances, their mixtures, factors or technological processes with carcinogenic or mutagenic in the workplace is a closed list. Therefore, if a technological process has not been included in it, it is not possible to report it as a process. In this case, the carcinogenic or mutagenic substances generated as by-products of the process should be reported and the process should be identified in Section B of the general part of Annex 2 in Chapter IV as justification for the use of carcinogenic or mutagenic chemicals.

    The regulations do not impose an obligation on employers to familiarize employees with safety data sheets. According to Art. 221 § 2 of the Labor Code, it is unacceptable to use a dangerous substance, a dangerous mixture, a hazardous substance or a hazardous mixture without having an up-to-date list of these substances and mixtures and safety data sheets, as well as packaging protecting against their harmful effects, fire or explosion.
