    • Further facilities in the field of preventive examinations during the epidemic (3)
Work is underway on further changes to the anti-crisis special act. This time, the changes are to largely concern the issue of preventive examinations and medical examinations necessary for the performance of certain professions.
    • Lower costs of preventive examinations and new methodological indications for their conduct (4)
At the end of last year, changes to the regulations on medical examinations of employees came into force. They concern, inter alia, the transfer of the obligation to perform specialist examinations (ophthalmic, neurological, laryngological) to the occupational medicine doctor conducting the examination. The changes are also to contribute to lowering the costs of preventive examinations.
    • Only 52 thousand. Control of the National Labor Inspectorate in 2021 (5)
Chief Labor Inspector Andrzej Kwaliński presented the NLI's action plan in 2021 at the Labor Protection Council meeting. The inspection will check how employers apply legal solutions related to fighting the pandemic and will conduct preventive actions to protect employees in the event of an epidemic threat. The inspections will also cover compliance with new legal solutions introduced by the regulations of anti-crisis shields.

    • OHS training for employees who remove roofs from snow (8)
Forecasts for this year's winter are still quite optimistic - rather warm and rainy. But the weather likes to surprise. If it does snow, the snow removal equipment will go in motion. Employees carrying out work involving snow removal from roofs are exposed to many occupational hazards. In addition to removing snow from roofs, they can also perform work related to the removal of overhangs, icicles, and clearing gutters and downspouts. One of the main risks, however, is a fall from a height, which is exacerbated by the need to walk on a slippery surface of the roof, often in unfavorable weather conditions. Proper training is the way to reduce the number of injuries and accidents at work.

    • "Unless the employer decides otherwise", i.e. on creating law during an epidemic (12)
The next bills that the government is preparing in connection with COVID-19 do not give rise to optimism. The legal trash in force until December 27 and December 2020 was the order to cover the mouth and nose in workplaces when more than one person was in the room. However, the employer could have decided that the above order would not apply and that it would not be necessary to wear masks at work. So, as always, everything is clear. Are you sure?

The health and safety service should perform ongoing monitoring of occupational hazards occurring in the plant. The above rule applies not only to the situation in which the employer has a health and safety unit, but also to smaller employers, where there is no obligation to appoint a health and safety service. Unfortunately, the laconic provision included in the catalog of tasks of the OHS service in practice gives more questions than answers.

    • How an employer can ensure the health and safety of remote workers (18)
Even 1/3 of employees can perform their duties remotely. Working at home is especially dangerous for the spine, but it can also lead to other chronic diseases if not reacted early. Employers have already noticed the problem. In many companies, internal information campaigns were introduced, as well as changes in preventive examinations counteracting the most important problems. So remember to keep your employees informed about the principles of safe remote work.
    • Deadline for the execution of the labor inspector's order can be negotiated (19)
If a labor inspector reveals any irregularities in the field of health and safety at work, an order, i.e. an administrative decision, should be expected. In most cases, such decisions are timely, and the deadline itself is set by the inspector. However, it is not always possible to meet it. Therefore, it is worth convincing the inspector of the need to extend it - even in a situation when a formal decision has already been issued.

    • Problematic determination of the beginning and end of the road to or from work (21)
To qualify an accident as an accident on the way to or from work, it is necessary to precisely determine the beginning and end of the journey to or from work. The doc -trine expresses the established position that the way to or from work begins when the employee leaves the door of the house (apartment) in which he lives or the gate of the workplace, and ends, respectively, on the border of the territory under the workplace or the threshold of the house (flat) in the employee's place of residence. But this issue is much more complex in the jurisprudence.
